Ortingo's User Agreement

1. Introduction

1A. Entry of Agreement

1AA. By using our site (the "site", the "platform", the "services", "us", "we", "our", "Ortingo"), whether or not you ("you", "your") are registered as a user, or authenticated as a registered user, you are automatically and legally protected by, subject to, and consented to this privacy policy (the "policy", the "agreement"), as this agreement, is, with accordance to, and depending on all and any pertaining and applicable local, state, federal and international laws pertaining to the jurisdiction in which you access and use our site, a legally binding agreement.

2. Age Restrictions

2A. United States

2AA. The minimum age for using Ortingo in a general manner, is 13 years. To view adult material, you must be at least 18 years of age. To view material containing mentions of alcohol and tobacco, you must be at least 21 years old.

2B. Foreign Jurisdictions

2BA. Foreign jurisdictions, other than the United States, may or may not allow for the use of our platform by individuals of ages less or greater than the minimum age limits specified for the United States. You agree to abide by and comply with all and any pertaining and applicable local, state, federal and international laws pertaining to the jurisdiction in which you access and use our site.

3. Code of Conduct

3A. General User Behavior

3AA. You are to treat users in a courteous, respectful, civil, friendly, open-minded and legal manner on this platform. Emotionally abusive, hateful, violent, and defamatory acts, such as libel and slander, or any other behavior of such nature through any form of communication are never tolerated, and prohibited. Ortingo is a place where people are entitled to a safe environment, where they can feel welcome and interact in harmony. If anyone on our platform commits any such acts towards you or anyone else in any way, please talk to us about the incident immediately. You can always reach out to us at Ortingo Support.

3B. NSFW (Not Safe for Work) Content

3BA. As a diligent, cautious user on our platform, it is your responsibility to ensure the content you view in sensitive environments, such as the workplace, is safe for such settings.

3C. Personally Identifiable Information (PII)

3CA. Your content should never contain personally identifiable information (PII), derivative of sources such as government-issued identification mediums, residential addresses, electronic communication addresses (i.e. email, phone, etc.), etc. that expose an individual to vulnerability by those with malicious intents. If you suspect anyone is uploading PII, please contact us at Ortingo Support.

3D. Indemnification

3DA. You (or Company ("Company")) agree to protect, defend, hold harmless, and indemnify (collectively “Indemnify” and “Indemnification”) Ortingo, its subsidiaries, and its and their respective successors, assigns, directors, officers, employees, agents, stockholders, and affiliates (collectively, “Indemnified Parties”) from and against all claims, demands, actions, suits, damages, liabilities, losses, settlements, judgments, costs, and expenses whether or not involving a claim by a third party, including but not limited to reasonable attorneys’ fees and costs (collectively, “Claims”), actually or allegedly, directly or indirectly, arising out of or related to (1) any breach of any representation or warranty of Company contained in this Agreement; (2) any breach or violation of any covenant or other obligation or duty of Company under this Agreement or under applicable law; (3) any third party Claims which arise out of, relate to or result from any act or omission of Company; and (4) other enumerated categories of claims and losses, in each case whether or not caused in whole or in part by the negligence of Ortingo, or any other Indemnified Party, and whether or not the relevant Claim has merit. Any advice you offer to users through any form of communication, is subject to all and any pertaining and applicable local, state, federal and international laws pertaining to the jurisdiction in which you access and use our site, in which you are liable, responsible and accountable for consequences requiring legal action. We are not liable, responsible nor accountable for any legal consequences occurring as a result of advice we did not offer.

3E. Copyright & Intellectual Property

3EA. As a user on our platform, your content, being unique, is your copyright — your content should never infringe the copyright, trademark(s), or intellectual work or property of third-party entities. Any trademarks belonging to any entity(ies) mentioned in your content are subject to all and any pertaining and applicable local, state, federal and international laws pertaining to the jurisdiction in which you access and use our site, as well as the jurisdiction of the copyright and/or trademark holder(s). In the event you want to include any entity's work other than your own, it is mandatory that you utilize the correct and proper use of citations in your content.

3F. Ortingo Branding & Intellectual Property

3FA. Ortingo reserves full rights to its brand (the "brand") and identity(ies), including itself, Ortingo, those of sister, parent and subsidiary entities, being Amerlo and SavantEngine, i.e. the name, logo, theme colors, and claimed fonts (if and where applicable on the platform), etc. of each respective brand. If you're interested in using our brand(s) for commercial or non-commercial purposes, please contact us at Ortingo Support to discuss your proposal further.

3G. Names & Pseudonyms

3GA. Using a pseudonym or alias upon the creation of your account, or changing your name in your account settings, unless clearly noted alongside your real name, may or may not necessarily be illegal, depending on all and any pertaining and applicable local, state, federal and international laws pertaining to the jurisdiction in which you access and use our site, in which case you may or may not be required to use your real name, as registered on your personal legal documents and records, such as your birth certificate. However, as an exception, using a pseudonym or alias is only allowed if you're the owner or operator of a business, company, or any other entity requiring the use of a name not pertaining to an individual, where your name cannot be used due to such limiting circumstances.

3H. Malicious Users

3HA. The malicious acts of spamming or scamming are never tolerated, and prohibited. If you suspect such acts are being committed on our site, please reach out to us at Ortingo Support, and we'll handle the situation. We do not recommend attempting to handle such situations yourself, other than reporting directly to us through Ortingo Support.

3I. Automated Scripts & Bots

3IA. The operation of automated scripts (also known as "bots", "robots", "scrapers", "spiders", or "crawlers"), specifically those of malicious intent, i.e. distributed denial-of-service (DDoS) attacks, are never tolerated, and prohibited. If you ethically operate any automated script(s), you would be fully compliant with this agreement, with respect to the other sections of this agreement, however, only if complying with our robots.txt file, or Robots Exclusion Standard. When necessary, engaging in strict, ethical operating standards, we operate our crawler, OrtingoBot, based on the legal and technical compliance pertaining to the numerous websites and web pages we crawl, and their operators, and would expect the same from you.

4. Opinion

4A. Collective Opinion

4AA. The opinion(s) reflected in content posted by creators do not necessarily reflect those of Ortingo as a collective entity.

If any of the above conditions are found to be violated, if applicable, your account will be terminated.

5. Billing Policy

5A. Billing Obligations

5AA. For Ortingo plans, or any product or service sold by Ortingo, payment in the full amount is due immediately for that product or service.

5B. Cancellations

5BA. Cancellation of an Ortingo plan can be requested at any time, no questions asked. If you're under a paid plan and want to delete your account, please chat with us at Ortingo Support to cancel your plan and stop recurring charges.
